Environmental damage actions and procedures: management and outcomes in practice of the Ministry of the Environment and Energy Security and the Italian Institute for Environmental Protection and Research

With a view to carrying out a shared in-depth study between ISPRA and the Ministry of the Environment and Energy Security, this Document addresses the topic of environmental damage actions and procedures by describing the sector's institutional set-up and the achieved results and by integrating the view of the Institute, which is responsible for coordinating the technical/scientific investigation within SNPA, and the view of the Ministry, which holds the power to activate actions and procedures. The Document presents a work of analysis and processing of data related to the management of environmental damage actions and procedures and data related to the consequent results obtained by the State (also represented in 45 case studies), with specific reference to a period of 6/7 years (2017-2023) following the establishment of SNPA. As of 2017, in fact, Law No. 132/2016 assigns to SNPA the task of providing support for state action on environmental damage in judicial and administrative proceedings. In this framework, the account of how the State has organized itself, on a managerial and procedural level, to achieve the remedying and prevention of environmental damage and the account of the outcomes that have been concretely achieved over the years (what has been achieved, what elements have led to favorable outcomes, what critical issues have been encountered, etc.) are the prerequisites for a new key to understanding environmental damage that is useful for the entire public. In fact, the Document is addressed to a wide range of recipients, such as administrations’ operators and control authorities interested in the application of the legislation on environmental damage (part six of Legislative Decree 152/2006), private operators, legal and insurance professionals, scholars of the subject and, more generally, all those interested in a topic of growing importance such as environmental damage.
